NOTICE IS HEREBY GIVEN, that the Board of Appeal and Equalization for the Township of Byron, Cass County, Minnesota shall meet on Thursday, April 16, 2020 at 10:00 a.m. at the Leader Community Hall. Section 13D.021, Subdivision 1, permits public bodies to hold meetings via telephone or other electronic means if the conditions of this section are met.

Section 13D.021 requires a public body to make a determination that an in-person meeting is “not practical or prudent because of a health pandemic or emergency declared under Chapter 12.” At this time, the governor has declared an emergency under Chapter 12.

Requirements for holding a meeting via telephone or other electronic means include:

•All participating members can hear one another.

•Members of the public at the physical meeting location can hear all discussion “unless attendance at the regular meeting location is not feasible due to the health pandemic.”

•At least one member of the public body is present at the meeting location, “unless unfeasible due to the health pandemic,” and

•All votes are taken by roll call.

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 18th day of February, 2020 at 9:00 a.m. The meeting was called to order by Chairperson Kircher. The meeting was opened with the Pledge of Allegiance. All Commissioners were present except Commissioner Erickson, who was absent.

Public Works

On motion by Kneisl and seconded by Becker, the following resolution was introduced and adopted by unanimous vote: 

MNDOT AGREEMENT 1036101 - TRUNK 

HIGHWAY 71 DETOUR

WHEREAS, the Minnesota Department of Transportation (MnDOT) plans on performing a bridge replacement project on Trunk Highway 71 over the Long Prairie River which is located in the City of Long Prairie in the summer of 2020, and;

WHEREAS, MnDOT requires a detour to carry Trunk Highway 71 traffic to County State Aid Highway 56 during the bridge project, and;

WHEREAS, MnDOT is willing to reimburse Todd County $1,185.24 for the road life consumed by the detour as hereinafter set forth, and;

WHEREAS, Minnesota Statute §471.59 subdivision 10, §161.25, and §161.20 subdivision 2(b) authorizes MnDOT and Todd County to enter into this agreement.

NOW, THEREFORE BE IT RESOLVED, that Todd County enter into MnDOT Agreement 1036101 with the State of Minnesota, Department of Transportation for the following purposes:

To provide for payment by the State to the County for the use of Todd County State Aid Highway 56 as a detour route during the contract construction to be performed upon, along and adjacent to Trunk Highway 71, over the Long Prairie River in Long Prairie under State Project No. 7708-41 (T.H. 71=004).

BE IT FURTHER RESOLVED, that the Chairperson of the Todd County Board of Commissioners and the Todd County Auditor/Treasurer are authorized to execute Agreement 1036101 and any amendments to the Agreement.

On motion by Neumann and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To set the 2020 Spring Road Meeting for April 14, 2020 at 9:00 a.m. at the Long Prairie Public Works Shop.

The County Board received an announcement from Region 5 Development Commission regarding a 2024 Federal Surface Transportation Block Grant Program Award for Todd County’s State Aid Highway #2 Project.

Planning & Zoning

On motion by Kneisl and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To grant the Conditional Use Permit with the propose conditions for Thirteen Acres, Inc. on parcel #06-0030600.

Health & Human Services

On motion by Kneisl and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To accept the update of Child Support Supervisor job description to Financial Support Services Supervisor job description.

On motion by Kneisl and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the request for TCHHS to recruit and hire one Child Support Officer.

On motion by Kneisl and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To authorize the hiring of one social worker to provide Childrens Mental Health-Targeted Case Management.

Discussion of concerns regarding the Sauk River Watershed and the Sauk River 1W1P was held.

On motion by Whitney and seconded by Williamson, the Todd County SWCD Board of Supervisors adjourned the joint meeting.

On motion by Kneisl and seconded by Neumann, the Todd County Board of Commissioners adjourned the joint meeting and reopened the regular County Board meeting.
