GENERAL NOTICE 

TO CONTROL 

OR ERADICATE NOXIOUS WEEDS

 

Notice is hereby given this 13th day of May, 2020, pursuant to Minnesota Statutes, Section 18.83, Subdivision 1 (2009), that all persons in Todd County, Minnesota, shall control or eradicate all noxious weeds on land they occupy or are required to maintain (Landowners are required to control noxious weeds on any land enrolled in CRP. Special attention needs to be devoted to covers established with native grasses, forbs or pollinator seed mixtures. Please call the FSA Office for control requirements). Control or eradication may be accomplished by any lawful method, but the method(s) applied may need to be repeated in order to prevent the spread of viable noxious weed seeds and other propagating parts to other lands. Failure to comply with the general notice may mean that an individual notice, Minnesota Statutes, Section 18.83, Subdivision 2 (2009), will be issued. An individual notice may be appealed within two working days of receipt to the appeal committee in the county where the land is located. Failure to comply with an individual notice may mean that the inspector having jurisdiction may either hire the work done or seek a misdemeanor charge against the person(s) who failed to comply. If the work is hired done by the inspector, the cost can be placed as a tax upon the land and collected as other real estate taxes are collected. 

You may obtain a list of the plants that are designated noxious and the members of the appeal committee from your County Agricultural Inspector. You can also obtain this information from your Local Weed Inspectors. Local Weed Inspectors include the township supervisors, city mayors or their appointed assistants. More information regarding the MN Noxious Weed Law and a list of County Agricultural Inspectors and County Designated Employees can be obtained from the Minnesota Department of Agriculture’s Web Site: https://www.mda.state.mn.us/plants-insects/minnesota-noxious-weed-list.

The noxious weeds that need to be: 

Eradicated are: Palmer amaranth, Oriental bittersweet, Diffuse knapweed, Brown knapweed, Yellow starthistle, Meadow knapweed, Poison hemlock, Black swallow-wort, Grecian foxglove, Common teasel, Cutleaf teasel, Giant hogweed, Japanese hops, Dalmatian toadflax, Japanese honeysuckle, and Tree of heaven. 

Controlled are: Common barberry, Narrowleaf bittercress, Plumeless thistle, Spotted knapweed, Canada thistle, Leafy spurge, Purple loosestrife, Wild parsnip, and Common tansy, Bohemian knotweed, Giant knotweed, and Japanese knotweed. 

Restricted Noxious Weeds are: Garlic mustard, Porcelain berry, Crown vetch, Wild carrot/Queen Anne’s Lace, Glossy buckthorn (and all cultivars), Amur honeysuckle, Morrow’s honeysuckle, Bell’s honeysuckle, Common or European buckthorn, Black locust, Multiflora rose, Tatarian honeysuckle, Japanese barberry cultivars, European alder, Non-native phragmites, and Siberian peashrub. 

Specially Regulated Plants are: Poison ivy, Amur maple, Norway maple, and Winged burning bush.

Notice is hereby given that the Board of Appeal and Equalization for Staples Township shall meet on Thursday, May 21, 2020 at 9:00 a.m. at the Staples Town Hall for the purpose of determining whether taxable property in the jurisdiction has been properly valued and classified by the assessor and to determine whether corrections need to be made.

If you believe the value or classification of your property is incorrect, please contact your assessor’s office to discuss your concerns. If you disagree with the valuation or classification after discussing it with your assessor, you may appear before the local Board of Appeal and Equalization. Notice is hereby given that a General Election will be held in Todd County on Tuesday, November 3, 2020 for the purpose of electing candidates for the Federal, State, Judicial, and County offices listed below. The filing period for the offices listed below begins at 8:00 a.m., Tuesday, May 19, 2020, and ends at 5:00 p.m., Tuesday, June 2, 2020.

The filing period for presidential elector candidates begins at 8:00 a.m., Tuesday, May 19, 2020 and ends at 5:00 p.m., Tuesday, August 18, 2020, for non-major political party candidates and independent candidates. The certification deadline for major political party presidential elector candidates is August 24, 2020.

Note: Filing offices will be closed Monday, May 25, 2020, in observance of Memorial Day and Friday, July 3, 2020, in observance of Independence Day.

Minutes of the EMERGENCY BOARD MEETING OF THE 

Todd County Board of Commissioners 

March 24, 2020

 

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 24th day of March, 2020 at 9:00 a.m. The meeting was called to order by Chairperson Kircher. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Neumann and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve the agenda as presented with the addition of item 5.2 EMS Services Report.

Todd County Board Chairperson

On motion by Erickson and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote:

A RESOLUTION DECLARING A LOCAL EMERGENCY

WHEREAS, The United States Centers for Disease Control and Prevention (CDC) has identified the public health threat posed by the COVID-19 pandemic; and,

WHEREAS, The President of the United States has declared that the COVID-19 outbreak in the United States constitutes a National Emergency; and,

WHEREAS, The Governor of Minnesota has declared a Peacetime State of Emergency to authorize any and all necessary resources to be used in support of the COVID-19 response; and,

WHEREAS, The White House, the CDC and the MDH now recommend restrictions on gatherings of more than 10 persons and further recommends practice of social distancing of at least 6-feet in all settings. 

WHEREAS, The significant community, organizational, institutional and business responses to the COVID-19 pandemic have the potential to compromise the provision of essential public services, including a reduction in the size of the workforce due to school closures, isolation, or quarantine.

WHEREAS, The necessary resources to respond to and recover from this pandemic, as well as to mitigate the significant business disruption experienced within the County, will exceed existing resources available within the County, and additional resources will be needed from Todd County, and state and federal sources.

NOW, THEREFORE BE IT RESOLVED, the Chairman of the Todd County Board of Commissioners, under the authority given in Minn. Stat. § 12.29 Subd.1, has declared that a local emergency exists within Todd County, effective March 23, 2020.

BE IT FURTHER RESOLVED, The Chairman of the Todd County Board of Commissioners hereby authorizes and directs Todd County Coordinator, public safety, public health and Emergency Management officials to undertake all actions necessary to protect the health, safety and welfare of the citizens of Todd County, including through the judicious exercise of the powers and responsibilities provided in Minn. Stat. § 12.37.

The Chairman of the Todd County Board of Commissioners further directs County Coordinator and County department heads to immediately review ordinance and regulatory requirements, operations, civil and legal proceedings, events, and resources that can and should be adjusted, modified or suspended, or to enact emergency regulations to support Todd County’s response to the COVID-19 pandemic.

The Chairman of the Todd County Board of Commissioners further directs the County Coordinator and County department heads to request and coordinate appropriate aid and resources from surrounding jurisdictions, the State of Minnesota and the federal government, as needed.

Further, under Minn. Stat. § 13D.021 and Minn. Stat. 373.052 Subd. 1b., the Chairman of the Todd County Board of Commissioners further directs the County Coordinator along with County department heads to take all right and prudent steps necessary to amend, suspend or otherwise adjust public access to County facilities, and normal locations, days and hours of County activities, operations and programs, in order to comply with the guidelines set by the White House, CDC and MDH for gatherings and social distancing, as well as based upon available County staffing and resources during this COVID-19 pandemic.

Further, under Minn. Stat. § 13D.021, the Chairman of the Todd County Board of Commissioners declares in-person meetings of the County Board of Commissioners and other public bodies of the County to be impractical or imprudent during the COVID-19 pandemic, under the guidelines set by the White House, CDC and MDH for gatherings and social distancing, thus leading the Chairman to direct that:

• Pursuant to Minn. Stat. § 13D.021, in-person meetings of the Todd County Board of Commissioners and other boards and commissions of Todd County are not practical or prudent due to the COVID-19 health pandemic and the emergency declared by Governor Walz pursuant to Minnesota Statutes, chapter 12. 

• Meetings of the County Board and other County boards and commissions may be conducted by telephone or other electronic means and live streamed via the County’s website and social media channels.

• In-person public attendance at meetings of the County Board, and other County boards and commissions is not feasible, except by limiting in-person public attendance to as few people as possible for the necessary conduct of the public’s business in the meeting room, with social distancing guidelines enforced, or as otherwise limited by recommendations and guidelines from state and federal authorities.

• County staff shall take such action as may be necessary to allow for such meetings to occur via telephone or other electronic means as well as live streamed via the County’s website and social media channels pursuant to Minnesota Statutes, § 13D.021, until such time as it is determined that in-person meetings may resume.

• County staff shall take such action as may be necessary to limit in-person public attendance to as few people as possible for the necessary conduct of the public’s business in a meeting room and enforce social distancing guidelines, or otherwise limit such attendance based on recommendations and guidelines from state and federal authorities.

• County staff shall take such action as may be necessary to live-stream meetings where in-person public attendance is limited in order to allow members of the public who wish to attend the meeting to hear all discussion and testimony and all votes of the members of the board or commission.   

Further, pursuant to Minn. Stat. § 12.29 Subd. 1, the Chairman of the Todd County Board of Commissioners directs that this emergency declaration is in effect from the date of this declaration, as indicated below, and shall continue and remain in effect as long as the State of Minnesota peacetime emergency declaration remains in effect, pending ratification by and official act of the Todd County Board of Commissioners within seventy-two (72) hours of this declaration. 

Further, the Chairman of the Todd County Board of Commissioners directs that this Declaration of Local Emergency, additions or changes to this declaration, the eventual termination or expiration of this declaration, and any and all official communications pertaining to the same, shall be given prompt and general publication, including on the County’s website and social media sites, and immediately filed by the County Clerk. 

Health & Human Services

Jackie Och, Health & Human Services Director provided an updated report on the COVID-19 pandemic for review and discussion.

A Situational Update report on Central MN Emergency Services board activities/concerns during the COVID-19 pandemic was provided for review and discussion.

On motion by Kneisl and seconded by Becker, the meeting was adjourned by unanimous rollcall vote.

On a motion by Kneisl and seconded by Neumann, the preceding minutes of the County Board meeting held March 17, 2020 were duly approved by unanimous vote at the Todd County Board of Commissioners at the Regular Board Meeting held on April 7, 2020.

On motion by Neumann and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote:

RESOLUTION 

FOR THE PURPOSES OF 

FAMILIES FIRST 

CORONAVIRUS RESPONSE ACT (FFCRA)

WHEREAS, the health, safety and well-being of the citizens of Todd County, as well as the employees of Todd County, is of great importance; and,

WHEREAS, employees of Todd County provide key services that impact the health, safety and well-being of or our citizens; and, 

WHEREAS, The Families First Coronavirus Response Act (FFCRA) requires certain employers to provide their employees with paid sick time and expanded family and medical leave for specified reasons related to COVID-19, and the provisions will apply from April 1, 2020 through December 31, 2020. 

WHEREAS, employers of health care providers or emergency responders, as defined by the U.S. Department of Labor, may elect to exclude such employees from eligibility for the paid sick leave or paid emergency family medical leave (EFMLA) provided under the FFCRA Act.

NOW, THEREFORE BE IT RESOLVED, that Todd County Board of Commissioners authorizes the Coordinator, along with the COVID-19 Emergency Executive Committee, to determine exclusions as defined by the U.S. Department of Labor. The current determination of Health Care Providers and Emergency Responders are positions of Sheriff’s Office, Health and Human Services, Public Works, Emergency Management Personnel, Attorney’s Office and MIS.  

BE IT FURTHER RESOLVED, The Todd County Board of Commissioners authorizes future exclusions as defined by the US Department of Labor to be reviewed and determined by the Coordinator, along with the COVID-19 Emergency Executive Committee.  

BE IT FURTHER RESOLVED, the Todd County Board of Commissioners authorizes using defined exclusions in determining who is eligible for Emergency Paid Sick Leave in the FFCRA. 

BE IT FURTHER RESOLVED, the Todd County Board of Commissioners authorizes using defined exclusions in determining who is eligible for Paid Emergency Family and Medical Leave Expansion Act (EFMLA).

BE IT FURTHER RESOLVED, the Todd County Board of Commissioners authorizes the use of vacation, comp or sick accruals, to supplement the 67 percent (%) pay.
