Todd County Board of Commissioners 

OCTOBER 1, 2019

 

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 1st day of October, 2019 at 9:00 a.m. The meeting was called to order by Chairperson Kneisl. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the agenda as presented with the addition of 15.2 Appoint Interim Coordinator to Full Time Coordinator.

Consent Agenda

On motion by Becker and seconded by Neumann, the following motions and resolutions were introduced and adopted by unanimous vote:

To approve the Commissioner’s Meeting Minutes for September 17, 2019 as presented.

To approve Trista Boyer to fill the open Care Coordinator position.

On motion by Neumann and seconded by Becker, the following resolution was introduced and adopted by unanimous vote:

COUNTY DITCH 

MAINTENANCE 

ASSESSMENTS FOR TAXES PAYABLE 2020

WHEREAS, the Auditor-Treasurer’s office along with the County Ditch Inspector have been proactively working on improving the cash flow balances within Fund-40 County Ditches on a yearly basis to maintain positive cash flow, and;

WHEREAS, per County Board suggestion, recommendations for the July 2018 through June 2019 assessment cycle were discussed at the County Board Work Session on September 17, 2019, and;

WHEREAS, Minnesota Statute allows for the Ditch Authority to approve maintenance fund assessments on a yearly basis without incurring the expense of a public hearing if statute requirement criteria have been met, and;

WHEREAS, it is the goal of the County Board to transition from the past practice of collecting after spending to maintaining a revolving collection comparative to expense trends and to keep assessments occurring as close to real time as possible for the potential property owners affected.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners in their capacity as the Todd County Ditch Authority hereby approves the Maintenance Fund/Ditch Assessments for the 2020 Tax Payable Year as a one year repayment period without interest applied per the attached list.

On motion by Kircher and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote:

REAPPOINTMENT OF DUANE GREWE TO THE

HOUSING AND 

REDEVELOPMENT AUTHORITY BOARD 

OF TODD COUNTY

WHEREAS, the Todd County Board of Commissioners of Todd County, Minnesota held a duly authorized special meeting on the 12th day of September, 1972; and

WHEREAS, at said meeting a resolution was passed and adopted declaring the need for a Housing and Redevelopment Authority in Todd County, Minnesota; and

WHEREAS, the current term for Duane Grewe on the Todd County HRA Board is set to expire on September 18, 2019.

NOW, THEREFORE BE IT RESOLVED, pursuant to the provisions of the Municipal Housing and Redevelopment Act of the State of Minnesota, the County Board of Commissioners of Todd County, Minnesota, hereby reappoint the one person hereinafter named to serve as Commissioner of the Housing and Redevelopment Authority of Todd County, Minnesota, and to serve for a period of five years as hereinafter stipulated:

Duane Grewe - renewal September 19, 2019 through September 18, 2024

On motion by Kircher and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote:

AUTHORIZING 

THE CLOSURE OF 

THE MINNESOTA 

HOUSING FINANCE AGENCY (MHFA) 

BANK ACCOUNT & FUND-13 REGISTER

WHEREAS, Todd County Health & Human Services contracted with the Minnesota Housing Finance Agency (MHFA) to administer home improvement loans through their revolving and deferred loan programs, and;

WHEREAS, administrative funds were provided to the County and kept in a separate bank account and Fund Register within the County’s Financial System, and;

WHEREAS, the volume of clients serviced utilizing this loan method was steadily decreasing, and;

WHEREAS, Todd County HHS ceased the processing of MHFA loans in July 2014 due to the retirement of the qualified staff, the expense to maintain qualified staff and the value of loan processing fees earned by the County.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners does hereby authorize the Todd County Auditor-Treasurer to perform any required actions to close the separate Bank Account and Fund-13 Register categorized as the MHFA account and redirect any remaining monies in this said account to Fund-11 Human Services.

On motion by Erickson and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote:

2019 PARKS

AND TRAILS

APPROPRIATION FUNDS TRANSFER

WHEREAS, the 2019 budget for Todd County’s allocation of funds to the Todd County Parks and Trails Board has been approved at $9,000; and 

WHEREAS, a letter was received from the Todd County Parks and Trails Board requesting for the appropriation of funds from the General Fund for 2019.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby approve the transfer of funds in the amount of $9,000 from the General Fund to the Parks and Trails Fund.

Hands of Hope Resource Center

On motion by Kircher and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote: 

2019 DOMESTIC 

VIOLENCE 

AWARENESS MONTH PROCLAMATION 

FOR TODD COUNTY

WHEREAS, it is a basic human right to live free of fear and violence. Our homes certainly should be that place. A place where we feel love, safety and security from the violence in our everyday world. A place of retreat and comfort; and

WHEREAS, scars of domestic violence cast a long lasting shadow on families and communities for generations without regard to race, gender, religion, income, age or occupation; and

WHEREAS, domestic violence strips individuals of their human dignity, self-esteem, security and safety by the use of systematic physical, emotional, sexual, psychological and economic abuse and control; and

WHEREAS, domestic violence is a crime, not just a family matter, it costs this nation billions of dollars every year in court and law enforcement costs, medical bills, lost time at work, shelters, foster care and loss of human lives; and

WHEREAS, in 2019 Hands of Hope Resource Center has provided assistance to 69 new individuals, male and female, as well as many secondary and child victims of domestic violence, and 40 repeat clients from previous years, families that live and work in your respective districts in Todd County. Families living in violence and fear; and

WHEREAS, this recurring crime needs the attention of all residents, judicial and law enforcement entities, faith communities, schools and employers. “See something, say something”, don’t be a “bystander”. Let’s join forces and cooperate to bring safety back to homes and to hold offenders accountable for their actions; and

NOW, THEREFORE LET IT BE RESOLVED, In recognition of the efforts of Hands of Hope Resource Center in addressing domestic violence, we the Todd County Board of Commissioners, do declare October 2019 as Domestic Violence Awareness Month in Todd County and urge our court and law enforcement system, and our communities to cooperate in a county-wide effort to address this crime and bring safety to all homes. 

Environmental Health Ordinance 2nd Reading

The Todd County Unified Environmental Health Ordinance has been updated to incorporate new state regulations. A Public Hearing was held to solicit public input of the 2nd Reading of the Ordinance proposal.

Great River Regional Library

An update of Great River Regional Library activities was provided by Karen Pundsack, Executive Director and Aron Murphy, Distribution Supervisor to the County Board.

Ditch/Ag Inspector

On motion by Becker and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To acknowledge receipt of a Hold Harmless Agreement petition from Linn Smith, to clean part of County Ditch 15 on parcel 02-0023100, Bertha Twp Section 28.

South Country Health Alliance

An update of 2019 SCHA activities was provided by Leota Lind to the County Board for review.

Solid Waste

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the bid from Farm Rite for the purchase of a Bobcat for $33,333.68 less $14,500 for trade-in for a total of $18,833.68 for replacement.

On motion by Erickson and seconded by Kircher, the following resolution was introduced and adopted by unanimous vote:

A RESOLUTION 

ESTABLISHING 

Market Price for the Solid Waste 

Management Tax

WHEREAS, the solid waste management tax requires political subdivisions to identify by resolution a market price if the political subdivision: Subsidizes the cost of service at a facility. 

WHEREAS, the political subdivision will be liable for the solid waste management tax based only on the market price amount identified through this resolution, and 

WHEREAS, the market price is identified in the state statutes as the “lowest price available in the area”, and 

WHEREAS, Todd County has performed research to identify the lowest price available in the area;

NOW, THEREFORE BE IT RESOLVED, the County of Todd declares a market price of $75 per ton at the Morrison County Landfill.

Planning & Zoning

On motion by Kircher and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote: 

A RESOLUTION 

REGARDING THE 

ADMINISTRATION

OF THE MINNESOTA WETLAND 

CONSERVATION ACT

WHEREAS, the Minnesota Wetland Conservation Act of 1991 (WCA) requires local government units (LGUs) to implement the rules and regulations promulgated by the Board of Water and Soil Resources (BWSR) pertaining to wetland draining, filling and excavation; and

WHEREAS, Minnesota Rules chapter 8420 have been adopted by BWSR in accordance with the rulemaking provisions of Minnesota Statutes, chapter 14, for the purpose of implementing WCA; and

WHEREAS, Minnesota Rules 8420.0200, Subpart 1, Item E allows a county, city, or town to delegate implementation of chapter 8420 and the act to another governmental entity by the passage of resolutions by both parties; and

WHEREAS, both parties must provide notice to BWSR, the Department of Natural Resources, and the Soil and Water Conservation District of the delegation, including a copy of the resolution and a description of the applicable geographic area, within 15 business days of adoption of the resolution; and

WHEREAS, City of Grey Eagle has passed Resolution #2018-10 delegating the implementation of Minnesota Rules Chapter 8420 to Todd County; and 

THEREFORE, BE IT RESOLVED that Todd County hereby accepts the authority and administrative responsibility to implement WCA as the LGU within the legal boundaries of the City of Grey Eagle as of May 1, 2018 in accordance with Minnesota Rules, Chapter 8420. 

On motion by Erickson and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote:

A RESOLUTION 

REGARDING THE

On motion by Kircher and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #11-0043800 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Neumann and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #15-0079700 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To place a $1,000 assessment on this property #08-0036300 for the 2020 tax year for failure to correct the violations.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To acknowledge that a violation existed on this property #21-0030300 that has been resolved.

On motion by Neumann and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #03-0038000 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Neumann and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #03-0036200 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Erickson and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #20-0015100 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Erickson and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #22-0007500 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Neumann and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #27-0007201 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Erickson and seconded by Neumann, the following motion was introduced and adopted by unanimous vote: To acknowledge the violation and place a $1,000 assessment on the property #19-0076400 for the 2020 tax year and further allowing the opportunity for the property owner to resolve the violation by December 30, 2019 at which time the County Board may choose to rescind this official action.

On motion by Becker and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the Policing Contract with the City of Clarissa effective January 1, 2020 for two years.

Health & Human Services

On motion by Kircher and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the 2020-2021 MFIP Biennial Service Agreement for program administration by Todd County.

On motion by Erickson and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the letter of support for the USDA Community Facilities grant.

Administration

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous Roll Call vote: To approve the attached County Coordinator job description.

On motion by Kircher and seconded by Erickson, the following motion was introduced: To appoint Interim Coordinator Chris Pelzer as the full-time County Coordinator.

Motion by Becker to table item 15.2.

During discussion, Sara Ogren, HR Manager advised the County Board that the open motion regarding appointment was not following procedure.

Due to lack of vote taken, the active motion was dismissed by the Chairperson.
