NOTICE

Kass Krest, LLP

Cass County

 

Notice is hereby given per Minnesota Statutes, Chapter 215, that Kass Krest, LLP has made an application to the Minnesota Pollution Control Agency / County of Cass to do an expansion on an existing livestock feedlot.

The existing Swine feedlot is located in the SW ¼ of the SW ¼ of Section 10 in Byron Township, in Cass County, Minnesota. The farrowing barn is a total confinement 181’ x 252’ with a 2’ concrete below barn pull plug manure storage system and holds 416 farrowing sows (weighing over 300 pounds) for a total of 166.4 animal units. The gestation barn is a total confinement 122’7” x 573’6” with an 8’ concrete below barn manure storage area that holds 2,080 head of sows (weighing over 300 pounds) or 832 animal units. The site currently has a permit for the following two barns. A total confinement gilt development unit 122’7” x 229’ x 8’ for 1,008 sows (weighing over 300 pounds) for 403.2 animal units and 1,600 developing gilts weighing between 55 and 300 pounds for 480 animal unit this barn would have a total of 883.2 animal units. A total confinement isolation barn 51’4” x 153’9” x 8’ that would hold 800 head of swine under 55 pounds for a total of 40 animal units. The GDU and ISO barns are proposed to be eliminated from the permit. Kass Krest, LLP is now proposing to construct another total confinement gestation barn that would be 122’7” x 630’with an 8’ concrete below barn manure storage area. This barn will hold 2,080 head of gestating sows (weighing over 300 pounds) or 832 animal units. The second proposed barn would be a total confinement farrowing barn 181’ x 197’ with a 2’ concrete below barn pull plug manure storage system that would hold 416 farrowing sows (weighing over 300 pounds) for a total of 166.4 animal units. Currently the site is permitted for 1,921.6 animal units. After construction the new total of animal units for this site will be 1,996.8 animal units.

This publication shall constitute as notice to each resident and each owner of real property within 5,000 feet of the perimeter of the proposed feedlot, as required by Minnesota State Law.

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 16th day of February, 2021 at 9:00 a.m. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

WHEREAS, the County Board of Commissioners of the County of Todd, State of Minnesota, desires to offer for sale certain parcels of land that have forfeited to the State of Minnesota for nonpayment of taxes, and

WHEREAS, said parcels of land have been viewed by the County Board of Commissioners and have been classified as non-conservation lands as provided for in Minnesota Statutes 282.01

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby certifies that all parcels of land on the attached list have been viewed and comply with the provisions of Minnesota Statutes 85.012, 92.461, 282.01, Subd. 8, and 282.018, and other statues that require the withholding of tax-forfeited lands from sale. (Unless otherwise stated.)The Todd County Board of Commissioners hereby certifies that the Soil and Water Conservation Board (of the district in which the land is located) has reviewed the attached land sale list and identified any and all non-forested marginal land and wetland.

BE IT FURTHER RESOLVED, which the Todd County Board of Commissioners hereby request approval from the Minnesota Department of Natural Resources for the Sale of tax forfeited parcels on the attached list.

WHEREAS, Todd County previously resolved to support watershed-scale planning efforts in the Sauk River Watershed consistent with Minnesota Statues, Chapter 103B.801, also known as One Watershed, One Plan - a program administered by the MN Board of Water and Soil Resources (BWSR); and

WHEREAS, to that end, Todd County entered into an agreement with partnering entities to develop and adopt a Comprehensive Watershed Management Plan (CWMP) for the Sauk River Watershed under Minnesota Statutes, Chapter 103B.801, and said agreement established a Policy Committee made up of one representative from each member’s governing board to oversee development of the CWMP in consideration of the One Watershed, One Plan program requirements; and 

WHEREAS, Todd County has received notice from said Policy Committee that: 1) the CWMP has been developed, 2) the CWMP has undergone the required public commentary period, 3) the statutory-required notice for the public hearing was published, 4) the statutory-required public hearing has been held for the public to provide comments on the CWMP, and 5) the Policy Committee has voted to recommend the CWMP to parties of the above-mentioned agreement; and 

WHEREAS, the above-mentioned agreement now requires each member to approve submission of the CWMP to the MN BWSR for its review and approval of the CWMP by the Policy Committee. 

NOW, THEREFORE, BE IT RESOLVED, the county hereby authorizes the Policy Committee to submit the Sauk River CWMP to the MN BWSR in fulfillment of the above-mentioned agreement.

On motion by Neumann and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the Kuhlmann Oaks Preliminary Plat with the one condition. 

Administration

On motion by Erickson and seconded by Kircher, the following resolution was introduced and adopted by unanimous vote: 

Adoption of 

Changes to Todd County Personnel Policy

WHEREAS, the Todd County Board of Commissioners has recognized a need for strong, up to date personnel policy, and;

WHEREAS, the Todd County Board of Commissioners and policies subcommittee have had an opportunity to review the policy revisions put forth in Article VII, Section 7.27 of the Personnel Policy and find the implementation to be in the best interest of the sound administration of the County;

NOW, THEREFORE BE IT RESOLVED, the Todd County Board of Commissioners adopts the attached changes to the Todd County Personnel Policy and directs the County Coordinator to begin administration of said policy as of February 16, 2021 and;

BE IT FURTHER RESOLVED, that it is understood that this Resolution replaces and supersedes all prior County Board actions, oral or written, relating to the subject matter hereof.

Now; Therefore, Be it Resolved, the Todd County SWCD hereby approves the bylaws, work plan and budget request for the Redeye Implementation Team, contingent on approval of the Redeye Implementation Team Policy Committee.

SWCD Chairperson Katterhagen adjourned the joint meeting.

On motion by Neumann and seconded by Kneisl, the Todd County Board of Commissioners adjourned the joint meeting and reopened the regular County Board meeting by unanimous Roll Call vote.
