Notice is hereby given that on Thursday, May 3, 2018 at 6:00 p.m. the Todd County Planning Commission will hold a public hearing in the Commissioners Meeting Room, 215 First Ave. South, Long Prairie to consider the following applications.

1. Paul Theisen Zoning Amendment: NE4 of SE4 of Sec 27 in Birchdale Township

Request to change the zoning district of this GOV 40 from R10 zoning to AF1 zoning for animal agriculture use purposes.

MINUTES 

 

Public Comment

Janna Floerke, Bob Floerke, Ron Hengemuhle, Nancy Taft and Mike Wiener addressed their concerns to the County Board in regards to concerns related to the Byler CUP request for a proposed greenhouse.

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 20th day of March, 2018 at 9:00 a.m. The meeting was called to order by Chairperson Neumann. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Erickson and seconded by Becker, the following motion was introduced and adopted by unanimous vote. To approve the agenda as presented.

Consent Agenda

On motion by Kircher and seconded by Kneisl, the following motions and resolutions were introduced and adopted by unanimous vote:

To approve the Commissioner’s Meeting Minutes for March 6, 2018 as presented.

To approve a one year Dance License for the Clarissa Ballroom at the address of 19281 Kotter Road, Clarissa, MN in Eagle Valley Township effective April 1, 2018 through March 31, 2019.

To approve a one year Off Sale and On Sale 3.2 Malt Liquor License and Setup License for the Clarissa Ballroom at the address of 19281 Kotter Road, Clarissa, MN in Eagle Valley Township effective April 1, 2018 through March 31, 2019.

EXCLUDED BINGO 

PERMIT – 

TODD COUNTY 

COUNCIL ON AGING

WHEREAS, the Todd County Board of Commissioners are establishing their approval for an Excluded Bingo Permit for the Todd County Council On Aging through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a one day Excluded Bingo Permit for the Todd County Council On Aging to hold bingo at the Clarissa Ballroom in Eagle Valley Township at the address 19281 Kotter Road, Clarissa, MN on April 8, 2018.

To approve the Partridge Creek Blinds & More 2018 tobacco license application.

Auditor-Treasurer

On motion by Becker and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the Commissioner Warrants number 48417 through 48532 in the amount of $132,447.22.

On motion by Kneisl and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To approve the Health & Human Services Warrants number 513605 through 513688 in the amount of $138,209.39 and warrants number 702362 through 702372 in the amount of $76,579.35.

On motion by Erickson and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To accept the Sales Order Agreement from Election Systems and Software for the 2018 election equipment purchases outlined by the Todd County Election Equipment Plan of the DS200 Tabulation System in the amount of $179,018.47.

On motion by Kircher and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote:

RESOLUTION FOR 

A PUBLIC LAND 

AUCTION OF TAX-

FORFEITED PARCELS IN TODD COUNTY

WHEREAS: Tax-Forfeited Parcels in Todd County have been reappraised and classified as provided by M.S. 282.01, and will be offered for sale by the Todd County Auditor/Treasurer at a public auction. 

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners do hereby approve said land auction to commence at 2:00 p.m. on the 13th day of April, 2018. The Todd County Auditor/Treasurer is hereby directed to publish a notice of the upcoming land auction as provided by law.

BE IT FURTHER RESOLVED, that the terms of sale are as follows:

All property is sold for cash or check only, no payment plans will be offered and full payment isdue on the date of sale.  

A charge of $25 will be made for each State Deed issued.

A charge of $46 will be made to record the State Deed.

State Deed Tax on the amount of purchase will be collected. (0.0033 x purchase price or minimum    of $1.65)

A $50 fee for well certificate, if applicable, will be collected. 

A Tax Forfeiture Administration fee of $250 will be collected. 

A three percent (3%) Assurance Fund charge will be made (as per M. S. 284.28, Subd. 8).

BE IT FURTHER RESOLVED, that Tax-Forfeited Parcels will be offered for sale subject to liens, existing roads, easements and leases, if any, and any special assessments canceled at forfeiture may be reassessed by the municipalities after the sale.

On motion by Erickson and seconded by Becker, the following resolution was introduced and adopted by unanimous vote:

RESOLUTION FOR 

A PRIVATE SALE OF 

A TAX FORFEITED PARCEL IN 

LONG PRAIRIE 

TOWNSHIP

WHEREAS, Parcel 18-0025403 described as Sect 20 TWP 129 Rang 33 - Service Road that is 40ft in Width & Comm at TWP Rd on S line of SE4 SW4 & Runs N’rly along W edge of Row of HWY 71 316.5 ft. .30 acres, has forfeited to the State for nonpayment of taxes. This Private Sale is to achieve the best use of Tax Forfeited parcel by adding it to its adjoining parcel.

NOW, THEREFORE BE IT RESOLVED, that said Private Sale will be finalized by April 6, 2018.

BE IT FURTHER RESOLVED, that the terms of sale are as follows:

All property is sold for cash only, full payment is due on the date of sale;

A charge of $250 will be made for County Administrative Fee;

A charge of $25 will be made for each State Deed issued;

A charge of $46 will be made to record the State Deed;

State Deed Tax on the amount of purchase will be collected (0.0033 x purchase price); and a three percent (3%) Assurance Fund charge will be made (as per Minnesota Statutes 284.28, Subd. 8). 

Only persons allowed to bid are adjacent owners.

BE IT FURTHER RESOLVED, that the right is reserved by Todd County, in the interest of the public, to cancel this sale at any time prior to its sale.

On motion by Becker and seconded by Kircher, the following resolution was introduced and adopted by unanimous vote:

RESOLUTION FOR 

AN ADJACENT OWNER SALE OF TAX 

FORFEITED PARCELS 

WHEREAS, Parcels 19-0045600, 19-0045601, 19-0043800 and 36-0064300 have forfeited to the State for nonpayment of taxes. This Adjacent Owner Sale is to clean up small sections of Tax Forfeited parcels and to achieve the best use of Tax Forfeited parcels by adding it to its adjoining parcel.

NOW, THEREFORE BE IT RESOLVED, that said Sale is for adjacent owners only.

BE IT FURTHER RESOLVED, that the terms of sale are as follows:

All property is sold for cash only, full payment is due on the date of sale;

A charge of $25 will be made for each State Deed issued;

Veterans Service

On motion by Kneisl and seconded by Kircher, the following resolution was introduced and adopted by unanimous vote:

RESOLUTION 

OF TODD COUNTY

WHEREAS, The Minnesota Department of Veterans Affairs is again conducting the County Veterans Service Office Operational Enhancement Grant and;

WHEREAS, The Todd County Veteran Service Office is eligible for the County Veterans Service Office Operational Enhancement Grant

NOW, THEREFORE BE IT RESOLVED, by the Todd County MN Board, that the County enter into the (attached) Grant Contract with the Minnesota Department of Veterans Affairs (MDVA) to conduct the following Program: County Veterans Service Office Operational Enhancement Grant Program. The grant must be used to provide outreach to the county’s veterans; to assist in the reintegration of combat veterans into society; to collaborate with other social service agencies, educational institutions, and other community organizations for the purposes of enhancing services offered to veterans; to reduce homelessness among veterans; and to enhance the operations of the county veterans service office, as specified in Minnesota Laws 2015 Chapter 77, Article 1, Section 37, Subdivision 2. This Grant should not be used to supplant or replace other funding.

BE IT FURTHER RESOLVED, by the Todd County Board, that Pete Berscheit, the Todd County Veteran Service Officer, be authorized to execute the attached Grant Contract for the above-mentioned Program on behalf of the County. 

Sheriff’s Office

On motion by Kircher and seconded by Becker, the following resolution was introduced and adopted by unanimous vote:

2018 BOAT AND WATER GRANT

WHEREAS, Todd County Sheriff Don Asmus has submitted the 2018 Boat and Water Safety Grant to the Todd County Board of Commissioners, and;

WHEREAS, in the Boat and Water Safety Grant it awards the amount of $6,645 to Todd County to carry out Minnesota’s Boat and Water Safety Rules.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners accept the 2018 Boat and Water Safety Grant authorize Sheriff Don Asmus to carry out the conditions of the grant. 

Planning & Zoning

On motion by Erickson and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To grant the CUP to operate a sawmill on PID 01-0031701 with one condition specified by Planning Commission.

On motion by Kneisl and seconded by Erickson, the following motion was introduced and adopted by majority vote with Kircher and Neumann against: To grant the CUP request on Parcel #17-0001101 with four conditions established for the case.

Administration

On motion by Erickson and seconded by Becker, the following resolution was introduced and adopted by unanimous vote:

A RESOLUTION 

AUTHORIZING 

COORDINATOR HATCH TO CONDUCT 

BUSINESS AND 

ACCEPT GRANT FUNDS FOR ROCK WALL 

CONDITION 

ASSESSMENT GRANT

WHEREAS, the historic Courthouse is registered on the national historic register, and;

WHEREAS, the Courthouse has a rock wall and;

WHEREAS, the rock wall has fallen into disrepair and a condition assessment conducted by an architect is required in order to apply for grant funds which may help to repair the wall and; 

WHEREAS, there is a small grant fund for projects valued at $10,000 or less which may be used to help defer the costs of the condition assessment and;

WHEREAS, in order to apply for the small grant an organization must authorize someone to conduct business and accept the grant funding on behalf of the organization;

NOW, THEREFORE BE IT RESOLVED, that Coordinator Hatch is duly authorized to conduct business and accept grant funding for the small grant application to potentially offset the costs of the rock wall condition assessment.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the Advisory Committee Application.

On motion by Kneisl and seconded by Becker, the following motion was introduced and adopted by unanimous vote: To approve the Coordinator/Solid Waste Director position description and hire Coordinator Hatch for the Position.

Auditor-Treasurer’s Report

The Auditor-Treasurer reported on current projects including tax statement preparations, upcoming audit preparations, finance committee meetings, upcoming annual township meeting, and the MACO 2018 Legislative platform. 

Commissioner’s Report

The Commissioners reported on the meetings that they had attended.

A video recording was presented for Commissioner Kircher in receiving the Tri County Community Action Partnership Award for a lifetime of service to the community. 

Coordinator’s Report

The Coordinator reported on the meetings attended and projects in-progress including current recruitments, upcoming training exercises and the upcoming CentraCare day at the Capitol.
