CITY OF STAPLES
ORDINANCE NO. 557
AN ORDINANCE REGARDING THE SALE OF PROPERTY
Sec. 1: The City of Staples is hereby empowered to sell the following real estate located in the City of Staples, County of Todd, State of Minnesota in accordance with the sale price to be authorized by the City Council:
Lot 2, Block 11, Searles Addition to Staples, Todd County, Minnesota; and
Lots 3, 7, 8, 9 and 10, Block 11, Searles First Addition to Staples, Todd County, Minnesota.
Sec. 2 : The net proceeds from the sale shall be used pursuant to Section 11.05 of the Staples City Charter.
Sec.3: The Mayor and City Administrator are authorized to execute any documents to complete the sale.
Sec. 4: This ordinance shall take effect from and after its passage and publication in accordance with law.

The successful bidder must be a “responsible contractor.” The term “responsible contractor” means a contractor as defined in Minnesota Statutes Section 16C.285, subdivision 3. A prime contractor shall include in its verification of compliance a list of all of its first-tier subcontractors that it intends to retain for work on the project. Before execution of a construction contract, a prime contractor shall submit a supplemental verification under oath confirming that all subcontractors and motor carriers that the prime contractor intends to use to perform project work have verified to the prime contractor, through a signed statement under oath by an owner or officer, that they meet the minimum criteria for a responsible contractor.
Bids may not be withdrawn within forty-five (45) days after the scheduled closing time for receiving bids without consent of the Owner. The Owner reserves the right to reject any and all bids and rebid the project until a satisfactory bid is received.
