ORDINANCE 526
INCREASE AGE TO PURCHASE AND SELL TOBACCO AND TOBACCO-RELATED DEVICES
THE CITY OF STAPLES DOES ORDAIN:
ARTICLE III. - SALE OF TOBACCO AND TOBACCO-RELATED DEVICES
Sec. 20-62. - Basis for denial of license.
(a) The following shall be grounds for denying the issuance or renewal of a license under this section:
(1) The applicant is under the age of 21 years;
Sec. 20-63. - Prohibited sales.
It shall be a violation of this section for any person to sell or offer to sell any tobacco, tobacco-related device, electronic delivery device, or nicotine or lobelia delivery product:
(2) To any person under the age of 21 years;
(3) By means of any type of vending machine, unless persons under the age of 21 are at all times prohibited from entering the licensed establishment;
Sec. 20-67. - Compliance checks and inspections.
All licensed premises shall be open to inspection by the city police department or other authorized city or county officials during regular business hours. From time to time, but at least once per year, the city or county shall conduct compliance checks by engaging, with the written consent of their parents or guardians, persons over the age of 15 years but less than 21 years, to enter the licensed premises to attempt to purchase tobacco, tobacco-related devices, electronic delivery devices, or nicotine or lobelia delivery products.
Sec. 20-68. - Other illegal acts.
Unless otherwise provided, the following acts shall be a violation of this article:
(1) Illegal sales. It shall be a violation of this section for any person to sell or otherwise provide any tobacco, tobacco-related device, electronic delivery device, or nicotine or lobelia delivery product to any person under the age of 21.
(2) Illegal possession. It shall be a violation of this section for any person under the age of 21 to have in his or her possession any tobacco, tobacco-related device, electronic delivery device, or nicotine or lobelia delivery product. This subdivision shall not apply to persons lawfully involved in a compliance check.
(3) Illegal use. It shall be a violation of this section for any person under the age of 21 to smoke, chew, sniff, or otherwise use any tobacco, tobacco-related device, electronic delivery device, or nicotine or lobelia delivery product.
(4) Illegal procurement. It shall be a violation of this section for any person under the age of 21 to purchase or attempt to purchase or otherwise obtain any tobacco, tobacco-related device, electronic delivery device, and nicotine or lobelia delivery product and it shall be a violation of this section for any person to purchase or otherwise obtain such items on behalf of another. It shall further be a violation for any person to coerce or attempt to coerce a person under the age of 21 to illegally purchase or otherwise obtain or use any tobacco, tobacco-related device, electronic delivery device, or nicotine or lobelia delivery product. This subdivision shall not apply to persons lawfully involved in a compliance check.
(5) Use of false identification. It shall be a violation of this section for anyone to attempt to disguise their true age by the use of a false form of identification, whether the identification is that of another person or one on which the age of the person has been modified or tampered with to represent an age older than the actual age of the person.
(6) Minor employee. It shall be a violation of this section for any person under the age of 21 years to sell tobacco, tobacco-related device, electronic delivery device, or nicotine or lobelia delivery product without direct supervision by a licensee’s employee who is 21 years or older.
This Ordinance is effective this 10th day of March, 2020.

The sale will be governed by the provisions of Minn. Stat. § 282.01 and by the resolution of the Todd County Board of Commissioners authorizing such sale. The resolution reads as follows:
BE IT RESOLVED, that all parcels of tax-forfeited land listed on the List of Tax-Forfeited Land be classified as nonconservation land; that the basic sale price of each parcel on List of Tax-Forfeited Land, that is on file with the Clerk of the County Board, be approved and authorization for a public sale of this land be granted, pursuant to Minn. Stat. § 282.01; that the sale will be held at 10:00 a.m., Friday, April 3, 2020, by the Todd County Auditor/Treasurer at the Commissioner board room in the Historical Courthouse, for not less than the basic sale price; and that all sales shall be full payment or on the terms set forth on the List of Tax-Forfeited Land.
BE IT FURTHER RESOLVED, that the conditions and terms of the public sale shall be as described in the list of Tax-Forfeited Land contained here-in and approved by the Todd County Board of Commissioners.

Notice is given that an Application for Informal Probate of Will and Informal Appointment of Personal Representative was filed with the Registrar, along with a Will dated July 11, 1980 pursuant to Min. Stat. § 524.2-513. The Registrar accepted the Application and appointed Nancy J. Sunder, whose address is 9139 Colfax Avenue South, Bloomington, MN 55420, to serve as the Personal Representative of the Decedent’s Estate.
Any heir or other interested persons may be entitled to appointment as personal representative or may object to the appointment of the Personal Representative. Any objection to the appointment of the Personal Representative must be filed with the Court, and any properly filed objection will be heard by the Court after notice is provided to interested persons of the date of hearing on the objection.
Unless objections are filed, and unless the Court orders otherwise, the Personal Representative has the full power to administer the Estate including, after 30 days from the date of issuance of letters of general administration, the power to sell, encumber, lease or distribute real estate owned by the Decedent.
Notice is also given that (subject to Minn. Stat. § 524.3-801) all creditors having claims against the Decedent’s estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.
A charitable beneficiary may request notice of the probate proceedings be given to the Attorney General pursuant to Minn. Stat. § 501B.41, subd. 5.
