Minutes of the Meeting of the Todd County Board of Commissioners held on

SEPT. 5, 2023

 

Public Comment

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 5th day of September, 2023 at 9 a.m. The meeting was called to order by Chairperson Neumann. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous vote: To adopt the agenda as presented with the noted correction to item 4.1 Meeting Minutes Approval – August 15, 2023 to correctly reflect the rollcall vote on the 2024 Commissioners Salary adoption.

Consent Agenda

On motion by Noska and second by Denny, the following motions and resolution were introduced and adopted by unanimous vote:

To approve the Todd County Board of Commissioner’s Meeting Minutes for August 15, 2023 as presented.

GAMBLING PERMIT – BROWERVILLE SPORTSMAN CLUB

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Browerville Sportsman Club through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Browerville Sportsman Club to hold a raffle event at the Clarissa Ballroom in Eagle Valley Township at the address 19281 Kotter Road, Clarissa, MN on March 3, 2024.

To approve a one day On Sale Temporary Liquor License for Ivy’s Legacy Foundation at the address of 10098 County 11, Sauk Centre, MN in Kandota Township effective Oct. 13, 2023.

To approve a one day Dance License for Saukinac Campground at the address of 21914 Bay Loop, Sauk Centre, MN in Kandota Township effective September 30th, 2023.

Accept Jaden Evenson resignation effective 08/16/2023.

Accept Travis Moller resignation effective 08/23/2023.

To approve Ashley Gray to fill the open Eligibility Worker position.  Grade 6, Step 2 at 22.33. Start date: TBD

To approve Jonathan Mattson to fill the approved Child Services Manager position, Grade 14 Step 4 at $37.76.  Start date: 9/6/2023

To approve the hire of Derek Eberle to fill the approved Child Services Supervisor position, Grade 13, Step 2 at $33.59. Start date 09/06/2023.

Commissioners

The Todd County Board of Commissioners with the support of County Department Heads dedicated a plaque in honor and memory of Commissioner Rod Erickson for his service and leadership in representing District 3 and Todd County as a whole.  Commissioner Erickson’s family was in attendance showing appreciation of this dedication.

Auditor-Treasurer

On motion by Becker and second by Noska, the following motion was introduced and adopted by unanimous rollcall vote: To approve the August 2023 Auditor Warrants number (ACH) 903427 through 903468 in the amount of $309,942.40 (Manual) 863 through 875 in the amount of $79,156.14 and (Regular) 241374 through 241496 in the amount of $1,184,570.72 for a total of $1,573,669.26.

On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous rollcall vote:  To approve the Commissioner Warrants number (ACH) 402730 through 402762 in the amount of $18,861.77 and (Regular) 57272 through 57323 in the amount of $99,238.16 for a total of $118,099.93.

On motion by Denny and second by Becker, the following motion was introduced and adopted by unanimous rollcall vote:  To approve the Health & Human Services Commissioner Warrants number (ACH) 804439 through 804477 and (Regular) 710934 through 711007 for a total of $129,886.35.

On motion by Becker and second by Noska, the following motion was introduced and adopted by unanimous rollcall vote:  To approve the Health & Human Services SSIS Warrants number (ACH) 601016 through 601027 and (Regular) 517475 through 517496 for a total amount of $76,546.74.

On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous vote:  To set the County Fee Schedule Public Hearing for October 3, 2023 to begin at 9:15 a.m. in the County Commissioners Board Room and instruct all appropriate legal notices be generated and published accordingly.

On motion by Becker and second by Noska, the following motion was introduced and adopted by unanimous vote:  To approve the car fleet vehicle purchase from Nyhus Chevrolet of Staples, MN for a 2020 Chevrolet Trax AWD for the total amount of $21,632.15.

Great River Regional Library

Karen Pundsack, GRRL Executive Director provided the County Board with a 2024 Budget presentation and update of activities for discussion.

Public Works

On motion by Becker and second by Denny, the following motion was introduced and adopted by unanimous vote:  To approve the attached Bridge #77K02 Cooperative Construction Agreement.

On motion by Becker and second by Denny, the following motion was introduced and adopted by unanimous vote:  To set the 2023 Fall Road Meeting for November 20, 2023 at 9 a.m. at Long Prairie Public Works Shop location.

Solid Waste

On motion by Denny and second by Noska, the following resolution was introduced and adopted by unanimous vote: 

A RESOLUTION ESTABLISHING MARKET PRICE FOR THE 

SOLID WASTE MANAGEMENT TAX 

WHEREAS, the solid waste management tax requires political subdivisions to identify by resolution a market price if the political subdivision subsidizes the cost of service at a facility.: and

WHEREAS, the political subdivision will be liable for the solid waste management tax based only on the market price amount identified through this resolution, and;

WHEREAS, the market price is identified in the state statutes as the “lowest price available in the area” and; 

WHEREAS. Todd County has performed research to identify the lowest price available in the area;

NOW, THEREFORE BE IT RESOLVED, the County of Todd declares a market price of $82 per ton at the Morrison County Landfill.

On motion by Denny and second by Noska, the following motion was introduced and adopted by unanimous vote:  To approve the HHW agreement with Crow Wing County.

Planning & Zoning

On motion by Noska and second by Denny, the following motion was introduced and adopted by unanimous vote:  To approve an extension to the final platting deadline of the Swartzentruber Amish Cemetery not to exceed October 18, 2024.

On motion by Denny and second by Noska, the following resolution was introduced and adopted by unanimous vote:  

Final Plat Approval – “Tschida Estates” Subdivision

WHEREAS, Applicants and property owners Aaron Rousselange applied to subdivide a property that is described as part of Government Lot Two of Section 15 of Kandota Township with the plat to be known as “Tschida Estates”,

WHEREAS, Tschida Estates consists of two lots; Block 1, Lot 1, 40,001 Square Feet; Block 1, Lot 2, 83,594 Square Feet, located in Shoreland Recreational Development Zoning District in Kandota Township,

WHEREAS, On July 6, 2023, the Todd County Planning Commission recommended the following property be considered for Subdivision pursuant to Todd County Subdivision Regulation and Ordinance:   

That part of Government Lot 2, Section 15, Township 127 North, Range 34 West, Todd County, Minnesota, described as follows:

WHEREAS, On July 18, 2023, the Todd County Board of Commissioners considered the Preliminary Plat for the above described property and approved the Tschida Estates preliminary plat with the following two conditions,

1. All new accesses must be approved by the road authority.

2. Accesses shall only be connected to Akela Drive.  No access shall be allowed via US Highway 71.

WHEREAS, the Planning & Zoning Department has completed the necessary final plat review and find that all items required for final plat approval have been completed. 

NOW, THEREFORE BE IT RESOLVED, the final plat of “Tschida Estates” be approved as presented.

On motion by Denny and second by Becker, the following resolution was introduced and adopted by unanimous vote:

Final Plat Approval – “DeSmith Addition” Subdivision

WHEREAS, Applicant and property owner Shawn DeSmith applied to subdivide a property that is described as part of Middendorf’s Subdivision Plat 2, of Birchdale Township with the plat to be known as “DeSmith Addition”,

WHEREAS, DeSmith Addition consists of one lot; Block 1, Lot 1, 2.34 acres±, located in Shoreland Recreational Development Zoning Districts in Birchdale Township,

WHEREAS, On July 6, 2023, the Todd County Planning Commission recommended the following property be considered for Subdivision pursuant to Todd County Subdivision Regulation and Ordinance:   

That part of Lot 3, Block One, MIDDENDORF’S SUBDIVISION PLAT 2, according to the recorded plat thereof, described as follows:

WHEREAS, On July 18th, 2023, the Todd County Board of Commissioners considered the Preliminary Plat for the above described property and approved the DeSmith Addition preliminary plat with no condition.

WHEREAS, the Planning & Zoning Department has completed the necessary final plat review and find that all items required for final plat approval have been completed. 

NOW, THEREFORE BE IT RESOLVED, the final plat of “DeSmith Addition” be approved as presented.

On motion by Noska and second by Denny, the following resolution was introduced and adopted by unanimous vote:

Final Plat Approval –  “Krolls First Addition” Subdivision

WHEREAS, Applicants and property owners Vernon J. Kroll applied to subdivide a property that is described as part of Government Lot 3, of Section 3, of Burnhamville Township with the plat to be known as “Krolls First Addition”,

WHEREAS, Krolls First Addition consists of two lots; Block 1, Lot 1, 6.53± acres; Block 1, Lot 2, 8.38± acres, located in Shoreland Recreational Development and Agriculture/Forestry-1 Zoning Districts in Burnhamville Township,

WHEREAS, On July 18, 2023, the Todd County Board of Commissioners considered the Preliminary Plat for the above described property and approved the Kroll’s First Addition preliminary plat with no condition.

WHEREAS, the Planning & Zoning Department has completed the necessary final plat review and find that all items required for final plat approval have been completed. 

NOW, THEREFORE BE IT RESOLVED, the final plat of “Krolls First Addition” be approved as presented.

On motion by Becker and second by Noska, the following motion was introduced and adopted by unanimous vote:  To approve the Land Use Permit application for Mike and Barb James on parcel 19-0023100.

Ditch/Ag Inspector

On motion by Noska and second by Becker, the following motion was introduced and adopted by unanimous vote:  Acting as Ditch Authority, approves hiring Corbin Excavating, Inc to maintain approximately 4,460 feet of lateral 4 that is south of 350th Street. Brush will be chipped, trees will be removed from one side and spoil will be excavated and leveled on that same side. The estimate for the project is $2.50 per foot for a total of $11,150.00.

Administration

On motion by Becker and second by Denny, the following motion was introduced and adopted by unanimous vote:  To resubmit the pre-application with the recommended change of $395,000.00 in requested MNHS funds instead of the previously submitted request of $404,460.

Finance Committee

On motion by Becker and second by Denny, the following resolution was introduced and adopted by unanimous vote: 

A RESOLUTION ADOPTING THE 2024 PRELIMINARY LEVY

WHEREAS, the Laws of the State of Minnesota direct that the Todd County Board of Commissioners are required to approve by resolution a preliminary levy no later than September 30 annually, and;

WHEREAS, The Todd County Board of Commissioners have considered the financial situation of the County and had an opportunity to deliberate the levying of property taxes upon property owners within the County.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve the 2024 Preliminary Levy for Todd County, for property taxes payable in 2024 per table below, with the authority to reduce this levy before the final levy deadline of December 30, 2023.

County Auditor-Treasurer’s Report

The County Auditor-Treasurer has no new business items to report.

County Commissioner’s Report

The Commissioners reported on meetings and events attended.

Commissioner Denny attended the Long Lakes Higgins tour and Prairie Lakes.

Commissioner Becker attended the County Employee Picnic, Wellness, Region V, Facilities, Personnel, Rainbow Rider, and has been contacted regarding an upcoming Lake Shamineau LID meeting.  Discussion on the LSLID project status and the potential funding coming from Morrison County was held with more information forthcoming.

Commissioner Noska attended the Long Lakes Higgins tour, Tri-CAP, and HRA meetings.

Commissioner Neumann attended the SRWD, County Employee Picnic, Park Board, Insurance Committee, Sauk River 1W1P, Opioid Advisory Council, property purchase signing, Facilities, CPT, Personnel, and Rainbow Rider meetings.

County Coordinator’s Report

The County Coordinator reported on meetings attended including similar meetings as the Board, AMC Cybersecurity taskforce, Broadband coalition and childcare group.  It was noted that funding for Opioid education for youth is moving forward and contact with Morrison County regarding the LSLID project will continue with updates provided to the Board.
