1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is attached to this Summons. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons. 

2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at:

3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint.

5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.

6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.

That part of Government Lot 2, Section 25, Township 129, Range 35, Todd County, Minnesota included in the following described parcel:

Starting at the Southeast corner of Lot 26 of Little Deer Beach Addition to Leslie Township as the point of beginning, thence going East on a straight line with South line of said Lot 26 to the center of the Township Road, thence Northerly along the center line of said road to a point in a straight line with the Northerly line of Lot 27 of Little Deer Beach Addition to Leslie Township, thence westerly along said line to the Northeast corner of said Lot 27, thence Southerly along the East line of said Lot 27 and Lot 26 to the point of beginning.

The object of this action is to:

1. Obtain an Order and declaratory judgment determining, adjudging, and decreeing that Plaintiff Mitchell McGlade is the owner in fee of the Property.

2. Obtain an Order and declaratory judgment determining, adjudging, and decreeing that the Defendants, or anyone claiming through them, have no right, title, interest, estate, or lien upon the Property.

3. For other relief that the Court deems just and equitable.

NOTICE 

OF PUBLIC SALE 

BY SEALED BID/PUBLIC AUCTION 

 

The County of Todd, a political subdivision organized under the laws of the State of Minnesota will be accepting sealed bids until November 8, 2016, at 10:00 a.m., at the Todd County Commissioner’s Room, 2151 1st Ave. S., Suite 300, Long Prairie, MN, for the purchase and sale of the land and buildings at Co. Rd. 56, Long Prairie, MN 56347. This parcel has been used as a Sherriff’s Impound Lot, Veteran’s Service Garage and Sentence to Serve Wood Sale lot. The parcel will be sold “AS IS” with no warranty whatsoever. Additionally there is no warranty on boundaries or legal descriptions. 

All bidders will complete, sign and submit a Purchase Agreement together with earnest money of $10,000.00 in the form a cashier’s check payable to Todd County. After opening of the sealed bids on November 8, 2016, at 10:00 a.m., any bona-fide bidder may raise their bid as in public auction until such time as a successful bidder is determined. The minimum bid which the Seller will consider is $277,185.00 plus any and all attorney fees incurred by the county in selling the real estate. 

The successful bidder will be required to complete the closing with full payment and possession in accordance with the terms of the purchase agreement. NOTICE is hereby given that the biennial election for the City of Staples, Todd and Wadena Counties, State of Minnesota, will be held on Tuesday, November 8, 2016 between the hours of 7:00 a.m. and 8:00 p.m. Polling place will be in the Staples Community Center located at 425 Fourth Street Northeast. Offices to be filled at this election are the Mayor and four City Council Members. The Mayor shall serve for a term of two (2) years. The three individuals receiving the highest number of votes for City Council Member shall serve for terms of four (4) years and the individual receiving the fourth highest number of votes for City Council Member shall serve for a term of two (2) years.
