PUBLIC NOTICE

APPEAL FOR A VARIANCE

 

Notice is hereby given that on Thursday, the 16th day of September, 2021, at 7:00 p.m., the Board of Adjustment will hold a public hearing on the application of Sherman L. and Rebecca A. Sheets, 11072 241st Ave., Staples, MN  56479, for a variance on the following described property: N1/2 SW1/4 SW1/4, Section 28, Township 134N, Range 33W, Thomastown Township, located in an A-3 General Agriculture District.

Application, if approved, would allow a second-split of a ¼ ¼ parcel of land.

All persons interested are invited to attend said hearing and be heard on this matter. Instructions for how to access the meeting electronically for observation purposes only will be on the County website calendar at www.co.wadena.mn.us. Written correspondence must be received by the Wadena County Zoning Office, 415 Jefferson St. S., Room 234, Wadena, MN  56482 before close of business the day of the hearing in order to be accepted and must include the full name and address of the person sending the correspondence in order to be accepted for presentation to the Adjustment Board at the public hearing.  The correspondence may be submitted in person, by U.S. Mail, or by e-mail to the Zoning Office but it MUST include the required information.

Aldrich Township is seeking bids for Road Maintenance work, including Plowing, Blading and Mowing the roadsides. July 20, 2021

 

Call to Order

The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long Prairie, MN on the 20th day of July, 2021 at 9:00 a.m. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners were present.

Approval of Agenda

On motion by Kircher and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve the agenda as presented.

Consent Agenda

On motion by Erickson and seconded by Neumann, the following motions were introduced and adopted by unanimous vote:

To approve the Todd County Board of Commissioner’s Meeting Minutes for July 6, 2021 as presented.

To hire Megan Benning as Clerical Intern for the Sheriff’s Office, start date 07/20/2021.

GAMBLING PERMIT – ROTARY CLUB OF 

SAUK CENTRE

WHEREAS, the Todd County Board of Commissioners are establishing their approval for a Gambling Permit for the Rotary Club of Sauk Centre through this resolution;

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve a Gambling Permit for the Rotary Club of Sauk Centre to hold a raffle event at the Greystone Golf Club in Kandota Township at the address 10548 Andrews Drive, Sauk Centre, MN on August 27, 2021.

To approve a one day On Sale Temporary Liquor License for the Long Prairie Lions Club at the address of 24257 Riverside Drive (Long Drive In), Long Prairie, MN in Long Prairie Township effective August 21, 2021.

Auditor-Treasurer

On motion by Neumann and seconded by Kneisl, the following motion was introduced and adopted by unanimous Roll Call vote: To approve the Commissioner Warrants number (ACH) 401342 through 401375 in the amount of $58,034.27 and (Regular) 54992 through 55040 in the amount of $70,090.75 for a total of $128,125.02.

On motion by Erickson and seconded by Kircher, the following motion was introduced and adopted by unanimous Roll Call vote: To approve the Health & Human Services Commissioner Warrants number (ACH) 801790 through 801861 and (Regular) 707972 through 708045 for a total amount of $89,783.03.

On motion by Kircher and seconded by Neumann, the following motion was introduced and adopted by unanimous Roll Call vote: To approve the Health & Human Services SSIS Warrants number (ACH) 600426 through 600440 and (Regular) 516430 through 416462 for a total amount of $70,662.98.

On motion by Kneisl and seconded by Neumann, the following resolution was introduced and adopted by unanimous vote:

A RESOLUTION FOR AN ADJACENT OWNER SALE ON TAX 

FORFEITED PARCELS 

IN TODD COUNTY

WHEREAS, Parcels 09-0011202 and 21-0007702 have forfeited to the State of Minnesota for nonpayment of property taxes. The goal of a private sale to the adjacent owner is to achieve the best use of Tax Forfeited parcel by adding it to its adjoining parcel.

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners do hereby approve the adjacent owner sale for parcels 09-0011202 and 21-0007702. The Todd County Auditor/Treasurer is hereby directed to mail letters to these adjacent owners.

BE IT FURTHER RESOLVED, that the terms of sale are as follow:

All property is sold for cash only, full payment is due on the date of sale;

A charge of $25 will be made for each State Deed issued;

A charge of $46 will be made to record the State Deed;

State Deed Tax on the amount of purchase will be collected (0.0033 x purchase price); 

A three percent (3%) Assurance Fund charge will be made (as per Minnesota Statutes 284.28, Subd. 8). 

Only persons allowed to bid on said parcels are adjacent owners.

BE IT FURTHER RESOLVED, that this private sale is available to adjacent owners until December 1, 2021. If these parcels noted above remain for sale after December 1, 2021 they will not be made available to the general public until the next public auction.

BE IT FURTHER RESOLVED, that the right is reserved by Todd County, in the interest of the public, to cancel this sale at any time prior to its sale.

On motion by Kneisl and seconded by Erickson, the following resolution was introduced and adopted by unanimous vote:

RESOLUTION FOR A PUBLIC LAND AUCTION OF  TAX-FORFEITED PARCELS IN TODD COUNTY

WHEREAS: Tax-Forfeited Parcels in Todd County have been reappraised and classified as provided by M.S. 282.01, and will be offered for sale by the Todd County Auditor/Treasurer at a public auction. 

NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners do hereby approve said land auction to commence at 10:00 a.m. on the 13th day of August, 2021. The Todd County Auditor/Treasurer is hereby directed to publish a notice of the upcoming land auction as provided by law.

BE IT FURTHER RESOLVED, that the terms of sale are as follows:

All property is sold for cash or check only, no payment plans will be offered and full payment is due on the date of sale.  

A charge of $25 will be made for each State Deed issued.

A charge of $46 will be made to record the State Deed.

State Deed Tax on the amount of purchase will be collected. (0.0033 x purchase price of more than 3k or minimum of $1.65)

A $50 fee for well certificate, if applicable, will be collected. 

A Tax Forfeiture Administration fee of $250 will be collected. 

A three percent (3%) Assurance Fund charge will be made (as per M. S. 284.28, Subd. 8).

BE IT FURTHER RESOLVED, that Tax-Forfeited Parcels will be offered for sale subject to liens, existing roads, easements and leases, if any, and any special assessments canceled at forfeiture may be reassessed by the municipalities after the sale.

BE IT FURTHER RESOLVED, that all Tax-Forfeited Parcels are sold as is.

BE IT FURTHER RESOLVED, that the right is reserved by Todd County, in the interest of the public, to cancel this sale at any time prior to its sale.

Motion by Neumann to appoint Eugene Mensen to the Sauk River Watershed Board of Managers. Motion failed due to lack of second.

On motion by Kircher and seconded by Kneisl, the following was introduced and adopted by majority vote with Neumann against: To appoint Curtis Botner to the Sauk River Watershed District Board of Managers for a three year term beginning July 20, 2021.

County Attorney

Discussion was held regarding the backlog of court cases due to COVID-19 and its impact on County Attorney resources.

On motion by Erickson and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To approve the use of ARP/CSLFRF to hire an Assistant County Attorney to increase speed of case resolution, and reduce backlog of Court cases due to the COVID-19 pandemic.

Initiative Foundation

Carl Newbanks provided an update to the County Board of Initiative Foundation activities including Todd County.

On motion by Kircher and seconded by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the annual contribution of $8,000 for the Initiative Foundation for the 2022 budget year.

Hilltop Regional Kitchen

Rick Hest provided an update to the County Board of the Hilltop Regional Kitchen activities.

On motion by Kircher and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve the annual contribution of $7,000 for Hilltop Regional Kitchen for the 2022 budget year.

Planning & Zoning

On motion by Erickson and seconded by Kircher, the following motion was introduced and adopted by unanimous vote: To grant the CUP request for Tim and  Karen Melby to establish a four (4) site campground as a Commercial PUD on parcel 06-0023702 with six conditions.

No action was taken on the Randy Jonas request for CUP due to formal withdrawal of the CUP request received from the applicant prior to the meeting.

On motion by Erickson and seconded by Kneisl, the following motion was introduced and adopted by unanimous vote: To grant the CUP request for Daniel Hershberger to establish a retail greenhouse on parcel 01-0016100 with four conditions.

Commissioners

On motion by Kircher and seconded by Kneisl, the following resolution was introduced and adopted by unanimous vote: 

PROCLAMATION OF COUNTY STAFF 

APPRECIATION DAY

WHEREAS, county staff serves as the cornerstone of this community, dedicating their time, skills, and expertise for the benefit of their neighbors; and

WHEREAS, Todd County staff went beyond expectations to continue delivering the necessary services to the citizens of Todd County during the COVID-19 pandemic; and

WHEREAS, in addition to their regular duties, many county staff were called upon and accepted new and challenging responsibilities during the pandemic; and

WHEREAS, Todd County staff continues their exemplary work as we turn the corner on the COVID-19 pandemic and continue with recovery efforts; and

WHEREAS, the work of Todd County staff over the past year and a half have kept our community safer, healthier, and productive throughout months of unprecedented global transition; and

WHEREAS, on June 16, 2021 Governor Walz proclaimed July 27, 2021 as County Staff Appreciation Day, in recognition of the great efforts set forth as described above;

NOW, THEREFORE BE IT RESOLVED, that we, the Todd County Board of Commissioners, proclaim July 27, 2021 as County Staff Appreciation Day and extend our thanks to the staff of Todd County, expressing deep gratitude for their commitment to excellence in public service during the COVID-19 pandemic.

Closed Session

Chair Becker closed the session at 10:42 a.m. pursuant to Minnesota Statute 13D.05 subd 3 (b) to discuss the civil suit Erickson, et al v. Pope County, et al., Court File number 19-cv-3061 with our attorney.

Chair Becker reopened the session at 11:38 a.m. and reported that litigation preparations are progressing.

The County Auditor-Treasurer had nothing to report.

County Coordinator’s Report

The County Coordinator had provided a note of gratitude to all county departments and the Ag Society regarding the well-attended Todd County Fair.
